2. Description of Services

Austin Home Service Pros provides home improvement and contracting services in the Austin, Texas metropolitan area. Our services include, but are not limited to, painting, remodeling, roofing, plumbing, electrical work, HVAC, flooring, fencing, power washing, and general handyman services. Specific services available may vary based on location and scheduling availability.

3. Consultations and Estimates

All consultations and estimates provided by Austin Home Service Pros are based on the information available at the time of assessment. Please be aware of the following:

• Estimates are not guaranteed final prices. The final cost may change based on actual conditions discovered during the work, such as hidden damage, code requirements, or material availability.
• We will communicate any significant changes to the scope or cost before proceeding with additional work.
• Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
• Material prices are subject to market fluctuations and may be adjusted if there is a significant change between the consultation date and the start of work.

4. Scheduling and Appointments

We strive to accommodate your preferred scheduling, but appointment times are approximate. Weather, job complexity, and unforeseen circumstances may affect scheduling. We will notify you as soon as possible if a delay or reschedule is necessary. We are not liable for delays caused by factors beyond our reasonable control.

5. Payment Terms

Payment is due upon completion of services unless an alternative arrangement has been agreed upon in writing. For larger projects, we may require a deposit or progress payments as outlined in your project agreement. We accept the following payment methods:

• Cash
• Check
• Credit and debit cards
• Digital payments (Venmo, Zelle, etc.)

Invoices not paid within 30 days of the due date may be subject to late fees. We reserve the right to suspend services on accounts with outstanding balances.

6. Warranties and Guarantees

Austin Home Service Pros stands behind the quality of our work:

• Labor guarantee: we provide a 90-day satisfaction guarantee on all labor performed. If you are not satisfied with our workmanship within 90 days of project completion, contact us and we will make it right at no additional cost.
• Materials: manufacturer warranties apply separately to all materials and products used. We will provide documentation for applicable manufacturer warranties upon request.
• Exclusions: warranties do not cover damage caused by misuse, neglect, normal wear and tear, or unauthorized modifications to completed work.

7. Limitation of Liability

To the fullest extent permitted by Texas law:

• Our total liability for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim.
• We are not liable for pre-existing conditions, including hidden damage, structural issues, or code violations that existed before our work began.
• We are not liable for indirect, incidental, consequential, or punitive damages, including loss of use, lost profits, or emotional distress.
• We are not responsible for damage caused by acts of God, including severe weather, flooding, earthquakes, or other natural events.

8. Property Access and Conditions

To perform our services effectively, we require the following from homeowners:

• Provide reasonable access to the work area, including clearing personal belongings and ensuring a safe working environment.
• Disclose any known hazards, such as asbestos, mold, structural concerns, or pest infestations, before work begins.
• Ensure pets and children are kept away from active work areas for safety.

We are not liable for pre-existing damage to your property. If we discover previously unknown issues during the course of work (such as water damage behind walls or faulty wiring), we will communicate the findings to you before proceeding with any additional repairs.

9. Cancellation Policy

We understand that plans change. Our cancellation policy is as follows:

• Cancellations made at least 24 hours before a scheduled appointment incur no charge.
• Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee to cover scheduling and preparation costs.
• Emergency situations will be handled on a case-by-case basis. We strive to be reasonable and fair.
• For projects already in progress, cancellation terms will be outlined in your project agreement. You will be responsible for work completed and materials purchased up to the point of cancellation.

10. Insurance

Austin Home Service Pros carries general liability insurance and workers' compensation insurance. We are licensed and insured as required by the State of Texas. Proof of insurance is available upon request.

11. Intellectual Property

All content on our website, including text, images, logos, graphics, and design, is the property of Austin Home Service Pros and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

12. Dispute Resolution

We are committed to resolving any disputes fairly and efficiently:

• Step 1 - Good faith negotiation: if a dispute arises, both parties agree to attempt to resolve it through direct communication and good faith negotiation.
• Step 2 - Mediation: if negotiation does not resolve the dispute, both parties agree to participate in non-binding mediation in Travis County, Texas, before pursuing legal action.
• Step 3 - Legal proceedings: any legal action must be filed in a court of competent jurisdiction in Travis County, Texas.

13. Indemnification

You agree to indemnify and hold harmless Austin Home Service Pros, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of our website, your violation of these terms, or your provision of inaccurate information that results in harm or liability.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

This includes, but is not limited to, natural disasters, severe weather, pandemics, government actions, supply chain disruptions, labor shortages, or utility failures.
